وستكون بدايتنا من ذكر حكم الشرع فيه حتى يكون الجميع على بينه

حكم التلقيح الصناعي :

قرار " المجمع الفقهي التابع لمنظمة المؤتمر الإسلامي : " لا حرج من اللجوء إليها عند الحاجة ، مع التأكيد على ضرورة أخذ كل الاحتياطات اللازمة " .


فتوى الشيخ محمد بن عثيمين رحمة الله عليه :

عن حكم إيداع بويضة المرأة في أنبوبة ، ثم تلقيحها بماء الرجل ، ثم إعادتها إلى رحِم المرأة لتأخذ مجراها في التكوين .
فأجاب :
" أ. إذا لم تكن حاجة لهذا العمل : فإننا لا نرى جوازه ؛ لأنه يتقدمه عملية جراحية لإخراج البويضة - كما ذكرتم في السؤال - ، وهذه العملية تحتاج إلى كشف العورة بدون حاجة ، ثم إلى جراحة ، يخشى أن يكون منها نتائج ولو في المستقبل البعيد ، من تغيير القناة ، أو حدوث التهابات .
ثم إن ترك الأمور على طبيعتها التي خلقها عليها أرحم الراحمين ، وأحكم الحاكمين : أكمل ، تأدباً مع الله سبحانه ، وأولى وأنفع من طرق يستحدثها المخلوق ، ربما يبدو له حُسنها في أول وهلة ، ثم يتبين فشلها بعد ذلك .
ب. إذا كان لهذا العمل حاجة : فإننا لا نرى به بأساً بشروط ثلاثة :
الأول : أن يتم هذا التلقيح بمني الزوج ، ولا يجوز أن يكون هذا التلقيح بمني غير الزوج ؛ لقول الله تعالى : ( وَاللَّهُ جَعَلَ لَكُمْ مِنْ أَنْفُسِكُمْ أَزْوَاجًا وَجَعَلَ لَكُمْ مِنْ أَزْوَاجِكُمْ بَنِينَ وَحَفَدَةً وَرَزَقَكُمْ مِنَ الطَّيِّبَاتِ أَفَبِالْبَاطِلِ يُؤْمِنُونَ وَبِنِعْمَةِ اللَّهِ هُمْ يَكْفُرُونَ ) النحل/72 ، فخص ذلك بالأزواج .
الثاني : أن تتم عملية إخراج المني من الرجل بطريق مباح ، بأن يكون ذلك عن طريق استمتاع الزوج السيد بزوجته ، فيستمتع بين فخذيها ، أو بيدها ، حتى يتم خروج المني ، ثم تلقح به البويضة .
الثالث : أن توضع البويضة بعد تلقيحها في رحم الزوجة ، فلا يجوز أن توضع في رحم امرأة سواها بأي حال من الأحوال ؛ لأنه يلزم منه إدخال ماء الرجل في رحم امرأة غير حلال له ، وقد قال الله تعالى : ( نِسَاؤُكُمْ حَرْثٌ لَكُمْ فَأْتُوا حَرْثَكُمْ أَنَّى شِئْتُمْ وَقَدِّمُوا لِأَنْفُسِكُمْ وَاتَّقُوا اللَّهَ وَاعْلَمُوا أَنَّكُمْ مُلَاقُوهُ وَبَشِّرِ الْمُؤْمِنِينَ ) البقرة/223 ، فخص الحرث بامرأة الرجل ، وهذا يقتضي أن تكون المرأة غير الزوجة غير محل لحرثه " . انتهىبتصرفيسير .

وقال – رحمه الله – أيضاً - :
التلقيح الصناعي : أن يُؤخَذ ماءُ الزوج ويُوضَع في رحم الزوجة عن طريق أنابيب ( إبرة ) ، وهذه المسألة خطيرة جدّاً ، ومَن الذي يأمن الطبيب أن يلقي نطفة فلان في رحم زوجة شخص آخر ؟! ولهذا نرى سدَّ الباب ، ولا نُفتي إلا في قضية معينة بحيث نعرف الرجل ، والمرأة ، والطبيب ، وأما فتح الباب : فيُخشى منه الشرُّ .
وليست المسألةُ هيِّنةً ؛ لأنه لو حصل فيها غش لزم إدخال نسب في نسب ، وصارت الفوضى في الأنساب ، وهذا مما يحرمه الشرع ، ولهذا قال النبي صلى الله عليه وسلم : ( لاَ تُوطأ حَامِل حَتَّى تَضَع ) ، فأنا لا أفتي في ذلك ، اللهمَّ إلا أن ترد إليَّ قضية معينة أعرف فيها الزوج ، والمرأة ، والطبيب .

الشيخ محمد المنجد :
ومن الطرق التي يسلكها الأطباء في الإنجاب : ما جاء في السؤال وهي ما يسمى " آي في أف " ( I V F ) وتتلخص هذه الطريقة في حث المبيضين على إنتاج عدد من البويضات مقارنة بما يكون من المرأة في وضعها الطبيعي وهو نزول بويضة واحدة ، ويتم ذلك بإعطاء المرأة إبرة الديكابيتيل Decapeptyl لتهيئة المبيضين للخطوة التي بعدها ، وهي الحقن بهرمونات لحث المبيضين على إنتاج عدد من البويضات ، وبعد التأكد من نمو البويضات : يتم إعطاء المرأة حقنة HCG لتُكمل بها نضوج البويضات قبل سحبها ، وعادة تعطى هذه الحقنة قبل 36 ساعة من عملية سحب البويضات ، ويتم بعدها سحب البويضات .
وفي يوم سحب البويضات يتم أخذ السائل المنوي من الزوج ويوضع مع كل بويضة 100000 حيوان منوي في " أنبوب اختبار " ليتم التلقيح ، وبعد يومين أو ثلاثة أيام تنقسم البويضة الملقحة لتكوِّن ما يسمى بـ " الجنين " ، وتصنف الأجنة حسب جودتها إلى 4 أصناف ، ويتم اختيار أفضل الأجنَّة لإرجاعها للرحم ، ثم توضع الأجنة في الرحم ، ثم يُجرى بعدها بفترة إجراء فحص للتأكد من وجود الحمل من عدمه ، ونسبة نجاح هذه العملية عند الأطباء من 30 إلى 40 % .
هذا ملخص ما ذكره الدكتور " أسامة صالحة " ، استشاري أمراض النساء والولادة وأمراض العقم وجراحة المناظير ( بريطانيا ) ، ومدير وحدة أطفال الأنابيب ، مستشفى دار الشفاء الجديد .

ثالثاً:
أما حكمها الشرعي : فهو المنع على الأحوط ، وهو قول الشيخ عبد الله الجبرين حفظه الله ، ونقله عن علماء اللجنة الدائمة - كما نقلناه عنه في جواب السؤال رقم ( 1992 ) - أو الجواز بشروط ، ومن هذه الشروط :
1. الحاجة الماسة إلى ذلك ، فليس تأخر الإنجاب سنَة أو سنتين بعذرٍ للزوجين بسلوك هذه الطريقة وأخواتها ، بل يصبروا فقد يجعل الله الفرج قريباً من غير وقوع في محظورات .
2. عدم كشف المرأة عورتها على رجال مع توفر النساء .
3. عدم جواز الاستمناء للزوج ، ويمكنه التمتع بامرأته دون الولوج ، وينزل المني به .
4. عدم حفظ بويضات المرأة ومني الزوج في ثلاجة لاستعمال آخر ، أو لموعد متأخر ، وعدم التأخر في وضعهما في رحم المرأة ، بل يُباشَر بذلك دون تأخر ؛ خشية الاختلاط مع غيرهما ؛ وخشية استعمالهما لأناس آخرين .
5. أن تكون النطفة من الزوج والبويضة من الزوجة ، والزراعة في رحم الزوجة ، ولا يجوز غير ذلك البتة ، وينظر جواب السؤال رقم : ( 21871 ) و ( 23104 ) .
6. الوثوق التام بمن يقوم بالعملية من الأطباء والطبيبات .
